Anterix Inc. Trademark Usage Guidelines

By using any of Anterix’s Trademarks, you acknowledge that Anterix is the sole owner of the Trademarks. Further, you agree not to interfere with Anterix’s rights in the Trademarks, or to harm or misuse any of the Trademarks, and agree that all goodwill derived from your use of the Trademarks, if any, exclusively inures to the benefit of and belongs to Anterix.

Anterix’s Trademarks may not be incorporated into your own product names, services, trademarks, logos, company names, domain names, or URLs. Anterix’s Trademarks must not be altered in any way (e.g., changing graphics, stylization, colors, spelling, inserting hyphens, or combining words). Anterix’s Trademarks should never be used by third parties without a license agreement, or valid one-time authorization of use provided by a person authorized by Anterix to provide such one-time authorization of use. Third parties should avoid using marks that are confusingly similar to any of Anterix’s marks.

Any questions regarding Anterix’s Trademarks should be directed to the Anterix Law Department. Please also contact the Law Department if you identify third party uses of Anterix’s Trademarks that are in violation of these guidelines.

Trademark Notices

The status of Anterix’s Trademarks should properly be designated using the correct trademark symbol (® or ™ for products, ® or ℠ for services) reflecting Anterix’s ownership of particular marks as set forth below. The ® symbol should be used whenever a registered mark is cited in connection with the goods or services for which it is registered. The™ or ℠ symbol should be used whenever an unregistered trademark is cited in connection with the goods or services for which it is used. The symbol should appear with each Trademark/Service Mark at the first occurrence and the most prominent use.

Below are the minimum notice requirements for certain specified uses of Anterix’s Trademarks. Where there is any doubt, over-marking is preferred.

  • In all print or electronic documents, use the trademark symbol following the mark when it first appears in the work, and in the most prominent use (e.g., the headline).
  • In multi-page documents, use the trademark symbol on the first appearance in each page.
  • On all packaging, use the trademark symbol in every reference to Anterix’s trademarks.

Each product packaging, document, advertising, video and/or other multimedia presentation in which any Anterix mark appears, whether in print or electronic form, must contain an attribution statement at or near the first appearance of the mark, or if multiple marks appear, in a logical and prominent place within the document. The attribution of Anterix’s ownership should be in the following formats:

For Unregistered Marks: “_____ ™ is a trademark of Anterix Inc.” or “_______™ and ________™ are trademarks of Anterix Inc.”; OR
For Registered Marks: “_____® is a registered trademark of Anterix Inc.” or “______® and _______ ® are registered trademarks of Anterix Inc.”

When referring to Anterix’s Trademarks, the Trademark must be presented in the same font style and size as the surrounding narrative text without bolding or stylization unless explicitly authorized.

Consistent Use as Distinctive Adjectives

Anterix’s Trademarks should never be used as a noun or verb. Anterix’s Trademarks should only be used as adjectives, followed immediately by a general description of the relevant product or service (e.g., “the CATALYX™ wireless access and bridging services”). Anterix’s trademarks should never be used as plurals or in the possessive form (unless the mark itself is plural or possessive).

When “Anterix” is used as a trade name rather than as a trademark to identify its products and services (e.g., Anterix Inc.), there is no need to include a trademark symbol after “Anterix,” and it may be appropriate to use Anterix in the possessive form without being followed by a generic term or description. When Anterix is used as a Trademark (e.g., when used as a brand name for a product or service, used as an adjective, and followed by a generic term or description for the product or service), the appropriate trademark symbol should be used.

The following is a non-exhaustive list of Anterix’s Trademarks, which may be updated from time to time and without notice. The list may not be comprehensive, and the omission of a Trademark owned and/or used by Anterix from the below list is not a waiver of any rights of Anterix and use of such mark or marks must be consistent with these Trademark Usage Guidelines.

Use of Anterix’s trademarks containing stylization or color should be reproduced and used with the same stylization or color.

Monitoring Improper Third-Party Usage

All references to Anterix’s Trademarks must be truthful, fair and not misleading. Anterix’s Trademarks may not be altered in any way. Anterix’s Trademarks should never be used in a way that could cause anyone to wrongly believe that products or services are offered, endorsed, or sponsored by Anterix or any of its subsidiaries if they are not. Any unlicensed uses of Anterix’s Trademarks by third parties must comply with applicable laws, and with these guidelines, which may be modified from time to time by Anterix in its sole discretion. All other uses of Anterix’s Trademarks require a license agreement.
